Copyright and Intellectual Property Policies
The following provides general policies and guidelines about copyright and intellectual property in relationship to UAL Digital Commons. If you have a question that you do not see answered here, please contact Dan Lee, Copyright Librarian at leed@u.library.arizona.edu or (520) 621-6433.
Depositing works into UAL Digital Commons results in the distribution of these works on the Web and copies made for preservation purposes. As these are rights of the copyright holder, to deposit works into UAL Digital Commons you must be authorized to do so. Authorization could be due to being the copyright holder, having permission or a license to deposit the work from the copyright holder, the deposit meeting one of the exemptions in the Copyright Act, or being eligible for the Fair Use defense.
If you own the copyright
UAL Digital Commons does not seek or claim copyright on any deposited works, nor does it seek revenue from deposited works. If you own the copyright to an item deposited in UAL Digital Commons you retain that copyright. Joint copyright owners must agree to a non-exclusive distribution and preservation license that allows UAL Digital Commons to disseminate the deposited work over the web and make copies of that work for preservation purposes. The UAL Digital Commons page will explicitly state that the deposited work is protected by copyright. Depositing your work in UAL Digital Commons automatically provides a time and date stamp that will verify your expression of an idea or document your research at a given point in time.
UA authors who submit works that are subject to ABOR and UA Intellectual Property policies
UA authors should consult with the University’s Office of Technology transfer prior to licensing or making their works available for re-use by others. See ABOR IP Policy 6-908 and UA IP Policy.
If you have already licensed or assigned your copyrights to a publisher
If you created the work to be deposited, but have contracted with a publisher or third party, your publisher might consent to your deposit of the work into UAL Digital Commons. More and more publishers, whether commercial or non-profit, will permit the deposit of a preprint or post-print online and include this permission into their copyright agreement with authors. You should review your own publication contract to determine whether that permission has been granted. General information is available on Sherpa's RoMEO website, where you may also search or browse for the name of your publisher. If your publisher is not listed in the Sherpa database, UAL Digital Commons staff would be happy to help you investigate this issue with your publisher. If you have your publisher’s permission to deposit this material into UAL Digital Commons, you must agree to the terms in the non-exclusive distribution and preservation license for UAL Digital Commons available at http [TBD]. This allows UAL Digital Commons to disseminate the deposited work over the web for non-profit educational use and make copies of that work for preservation purposes. If there are specific conditions for the deposit of the material (for example, that it must include the citation information or must be withheld from posting for a specific period time), please note that when you deposit the work. If The University of Arizona/Arizona Board of Regents (ABOR) owns the copyright
If the work to be deposited was created as part of your employment at The University of Arizona, then ABOR owns the copyright, subject to limited exceptions. See The University of Arizona and ABOR Intellectual Property Policy. For the cases where ABOR owns the copyright, UAL Digital Commons requests that the author determines whether or not the work is appropriate for deposit by contacting the Director of UA’s Office of Technology Transfer.
General
As a condition of your deposit of your material into UAL Digital Commons, all authors must agree to the terms in the non-exclusive distribution and preservation license for UAL Digital Commons available at [TBD].
